BOTFUSION TECH – PRIVACY POLICY
These Privacy Policy (“Policy”) terms constitute a legally binding agreement between BotFusion Tech, a Nevada general partnership (“Company,” “we,” “us”), and the business entity or authorized representative accessing or using the Company’s services (“Client,” “you”).
By accessing, submitting information through, or using any Company services, websites, funnels, forms, calendars, chatbots, automations, or communications systems (including those built on GoHighLevel or similar platforms), Client acknowledges that it has read, understood, and agrees to be bound by this Policy.
1. Scope of This Privacy Policy
This Policy governs the collection, use, processing, storage, and disclosure of information obtained through the Services.
All Services are provided strictly on a business-to-business basis. Company does not provide consumer-facing services.
2. Information Collected
Company may collect information voluntarily provided by Clients or their end users, including but not limited to:
-Name
-Email address
-Phone number
-Business name
-Appointment or booking details
-Message content submitted via forms, chatbots, or SMS
-Any other information submitted through the Services
Company may also collect technical and usage data automatically, including but not limited to, browser type, device information, pages viewed, interaction data, cookies, pixels, and analytics information.
3. Cookies, Pixels & Tracking Technologies
Company may use cookies, pixels, web beacons, analytics tools, and similar technologies to operate and improve the Services, analyze usage, and support attribution tracking.
Disabling cookies through browser settings may limit functionality. Company is not responsible for performance issues caused by user-side restrictions.
4. How Information Is Used
Information collected may be used to:
-Operate, maintain, and deliver the Services
-Configure and support AI chatbots, automations, and workflows
-Route leads, messages, and appointment requests to Clients
-Send transactional or service-related notifications
-Enable SMS, email, and voice communications
-Improve system performance and security
-Enforce agreements and prevent misuse
-Comply with legal obligations
Company does not sell personal information.
5. SMS, Email, Voice & Messaging Consent
The Services may enable Clients to send SMS, MMS, email, and voice communications, including automated and AI-assisted messages.
Client represents and warrants that it has obtained all legally required express consent from recipients prior to sending any communications using the Services.
All SMS messages must include clear opt-out instructions, such as: “Reply STOP to opt out.”
Opt-out requests are honored where supported by the messaging provider. Message frequency varies based on Client use.
Company does not initiate communications on its own behalf and does not share, sell, or rent phone numbers for marketing purposes.
6. Data Controller & Processor Roles
Client is the data controller for all data collected from its customers, leads, or users.
Company acts solely as a service provider / data processor, processing data only according to Client instructions and system configurations.
Company is not responsible for how Client collects, uses, stores, or discloses personal information, or for Client compliance with privacy or communications laws.
7. Disclosure of Information
Company may disclose information:
-To Clients when data is submitted through their systems
-To third-party service providers required to operate the Services
-To comply with legal requirements or lawful requests
-To protect Company rights, safety, or property
-In connection with a merger, sale, or transfer of assets
8. Third-Party Platforms
The Services integrate with third-party platforms, including CRM systems, automation tools, messaging providers, AI providers, hosting services, and analytics platforms (“Third-Party Services”).
Company does not control Third-Party Services and is not responsible for their privacy practices, availability, security, or policy changes. Use of Third-Party Services is governed solely by their respective terms.
9. Data Security
Company implements reasonable administrative, technical, and physical safeguards to protect information processed through the Services. However, no system is completely secure, and transmission of information occurs at Client’s own risk.
10. Data Retention
Information is retained only as long as reasonably necessary to provide the Services, meet contractual obligations, comply with legal requirements, or protect Company interests.
11. User Rights & Requests
For data collected on behalf of a Client, the Client is responsible for handling access, correction, or deletion requests.

12. Children’s Privacy
The Services are not intended for individuals under the age of 18. Company does not knowingly collect personal information from minors.
13. No Compliance Warranties
Company makes no representations or warranties regarding compliance with privacy, data protection, marketing, or communications laws.
Client is solely responsible for ensuring compliance with all applicable laws, including but not limited to TCPA, CAN-SPAM, and carrier policies.
14. Limitation of Liability
To the maximum extent permitted by law, Company shall not be liable for any damages arising from or related to the collection, use, disclosure, or processing of information through the Services.
15. Governing Law
This Privacy Policy shall be governed by and construed in accordance with the laws of the State of Nevada.
16. Changes to This Policy
Company may update this Policy at any time. Continued use of the Services constitutes acceptance of the updated Policy.
